Background

The overarching Public Administration Reform (PAR) Strategy 2016-2020[1] adopted by the Government this year features improving public services delivery as one of the central priorities. Along with the service quality, reasonable cost for individuals and businesses, an infrastructure ensuring service provision, one of the main pillars set in the PAR Strategy is the improve of public services accessibility for citizens. The following Action Plan on the Public Services Modernization 2017-2021[2] foresees a number of measures in the area of better accessibility to public services. One of these measures is the creation of the Unified Centers of Public Services Delivery working in accordance with one-stop shop principles.  

In 2013, the Government adopted a decision on the creation of the Joint Information and Services Bureaus (JISB)[3] to provide a better accessibility to public services at local level. The JISB implies a joint platform, whereby key public, private and CSO service providers in the areas of social protection, employment, business development, agriculture and land, legal services, financial and other service providers come together and provide coordinated services to citizens at rayon and periodically at rural level. Although creation of JISBs contributed to the improvement of public services accessibility for citizens at local level, however, JISBs still serve as an information focal point on the public services rather than a proper service provider. 

MiLab with the support of the UN Women initiated a redesign process of JISBs in three pilot rayons – Dubasari, Calarasi and Rezina. The scope of the redesign was to figure out the main deficiencies of JISBs based on the insights of service providers and citizens, and come up with solutions to tackle the existing problems of JISBs functioning. As a result, the core problems identified during the ethnographic research are inability of citizens to resolve the problem and lack of efficiency of the provided assistance. In order to tackle this issue, MiLab will elaborate a new model of JISBs to enable JISBs to provide public services directly to citizens in compliance with one-stop shop principles.        

Therefore, UNDP Moldova is looking for a national consultant who would assist the MiLab team in the development of legal and institutional framework of a new JISB model.

Scope of work

The national consultant is expected to provide support to MiLab, in close collaboration with State Chancellery, JISB Service providers and LPAs from the pilot districts (Calarasi, Dubasari and Rezina), in elaborating legal and institutional framework for JISB model as a “one-stop shop” service provider which include:

 

  • Analysis of the legislation on the interoperability (data exchange) between state institutions in order to make JISB a part of interoperability mechanism;
  • Analysis of legal regulations on personal data protection in the light of JISB functioning as a “one-stop shop service provider;
  • Analysis of legislation on digital signature, and provision of recommendations on the usage of “third party” (signing of the documents for others) digital signature;
  • Elaborating LPA I and LPA II internal regulations establishing legal basis for the functioning of JISB as a “one-stop shop” service provider;
  • Revision of the JISB Government Regulation 661 from the perspective functioning of the as a JISB as a “one-stop shop” service provider;
  • Analysis of national legislation which can affect the functioning of the as a JISB as a “one-stop shop” service provider;
  • Elaboration of recommendations in order to create legal grounds for the piloting of JISB model in selected rayons;
  • Communicating with state institutions, JISB service providers, service users from the pilot districts and other key stakeholders.

Requirements for experience

I. Education:

  • University degree in law, public administration, international relations/development studies;

II. Years of experience:

  • At least five (5) years of experience in legal drafting (e.g. laws, governmental decisions, internal regulations of public institutions, etc.);
  • At least five(5) experience in working with Moldovan central and local public administration institutions;
  • Working experience in the field of personal data protection;
  • Working experience with digital instruments (such as interoperability, M-Sign, M-Pass, etc.);
  • Previous experience in development assistance or related work for a donor organization, governmental institutions, NGO/think-tank or private sector / business consulting firm is a strong advantage;
  • Previous experience in working within UNDP or other international organizations will be an asset.

III. Competencies:

  • Fluency in both oral and written Romanian and Russian is a must; knowledge of English is an advantage.
  • Working knowledge of one or more additional languages relevant for Moldova, including Bulgarian, Gagauzian, Romani, Ukrainian or sign language is an asset;
  • Proven knowledge of Moldovan legal framework (public administration and public services);
  • Understanding of Moldovan public service system (especially for the perspective of design and delivery at all levels);
  • Understanding existing digital instruments (such as interoperability, M-Sign, M-Pass, etc.) will be a strong advantage;
  • Understanding of Moldovan citizens’ rights protection mechanism in the context of using/ offering access to personal data;
  • Proven knowledge of personal data protection legal framework.

IV. Personal qualities:

Documents to be included

Interested individual consultants must submit the following documents/information to demonstrate their qualifications:

 

  1. Personal CV including past experience in similar projects and the contact details of at least 3 job-related reference persons.
  2. Financial proposal: in (USD, specifying a total lump sum amount and the number of anticipated working days).

Financial proposal

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in instalments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals the financial proposal shall include a breakdown of this lump sum amount (including fee, taxes, travel, per diems, and number of anticipated working days).

Travel

 

All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general, UNDP should not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources.

 

In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed.
